In April, following the problems with the renewal of EU State Aid for the Enterprise Management Incentive (EMI), we passed on advice from HMRC who advised that companies should consider delaying the grant of employee share options intended to qualify as EMI options until fresh EU State Aid approval has been given.
We are now pleased to confirm that the European Commission has now approved under EU State aid, the prolongation of the UK Enterprise Management Initiative scheme. Full details can be found here “State aid: Commission approves prolongation of UK Enterprise Management Initiative scheme”). Therefore, you may now grant EMI share options once again.
